Our civil department has grown substantially in the last 10 years. Its purpose is to deal with internal referrals from clients or previous clients, such as employment issues, difficulties with wills, or boundary disputes. Its other role is to provide these services to new clients. Importantly, at Robinsons, we still deal with the full range of general civil work, where available, on the basis of public funding.
Whether an architect, surveyor, solicitor or indeed any other professional, if you do not feel you have received the service you deserved, we can advise whether a potential claim may be available to you to recoup any losses suffered. Generally, all professionals are insured against such claims.
We will also discuss with you funding options for any claim you may have as in some circumstances Professional Negligence claims are suitable for Conditional Fee Agreements. We will advise you if this applies in your case.
As a consumer/customer, you are protected against unfair standard terms in contracts you make with traders by the Unfair Terms in Consumer Contracts Regulations (UTCCRs). This can protect you from terms that reduce your statutory or common law rights and from terms that are unfair.
Consumer contracts must be written in plain and clear language. Technical phrases and jargon cannot be used. The Court’s position is that you are in a weaker position when dealing with a business if you are an individual.
An unfair term in a contract covered by the UTCCRs is not binding on you.
If you have a problem with goods you have purchased, we can assist in negotiating a satisfactory resolution. If necessary, we will act for you in enforcing your rights through the courts.
Housing for landlords
We can offer advice and assistance on all issues concerning residential tenancies. Letting out a property is regulated and controlled and landlords need to ensure they comply with all relevant rules.
We can provide help to draft tenancy agreements, settle disagreements with tenancy and in the most serious circumstances advise as to the legal procedures to regain possession through the courts.
Housing for tenants
Advice about tenants’ legal rights is basic and fundamental to ensuring access to affordable and secure housing. Housing problems can have a devastating effect on individuals and families.
We understand that as a tenant or leaseholder a housing issue may arise from other problems such as loss of employment, ill health or disability. Receiving advice regarding your rights having appropriate legal help at these times can prevent the situation turning into a crisis.
We also understand that in some cases you may have been unable to seek advice before the situation has reached a serious stage and that you may need a solicitor who can act quickly and sympathetically.
It is often the case that building disputes arise concerning quality of work, timing and exact specifications of a particular build.
Whether it be on small individual matters or on large building contracts, we are able to assist and advise and, where necessary, in instructing and using building and surveying experts.
An important matter to consider in any building dispute is whether alternative dispute resolution by way of mediation or arbitration would be of assistance to the parties. The use of this facility can often bring a cost-effective resolution.
If it is not possible to resolve matters by way of alternative dispute resolution, we can deal with and progress the case through the Courts
